Description
The City of Bothell, WA (City) requests proposals to provide Public Defender services to indigent criminal defendants before the Bothell Municipal Court (Municipal Court). The City is interested in public defenders by routine appointment. General Description. Pursuant to Chapter 10.101 RCW, all indigent criminal defendants must be provided with effective legal representation. By Administrative Order 1.4.1 the City has adopted standards for the provision of public defense services as required by state law (see attachment A). The Supreme Court of Washington has adopted revisions to Standard 3.4 implementing Court Rule CrR 3.1 which establishes case count standards for public defenders. The City uses an unweighted standard. The Public Defender will provide legal representation for eligible defendants from court appointment or screening through trial, sentencing, post-conviction review and any appeals to Superior Court. The Public Defender, or subcontractor of the Public Defender, will: (A) Attend and appropriately represent assigned clients at all arraignment calendars, status conferences and court hearings required by the Municipal Court as now or hereafter adopted; (B) Attend and appropriately represent assigned clients at all hearings and trials involving defendants on whose behalf the Public Defender has been appointed; and (C) Be available to talk with and meet, in person, eligible indigent defendants at any of the City’s contract jails and Municipal Court; (D) Assess each client’s ability to understand English and need for an interpreter, each client’s competency; each client’s literacy, and each client’s citizenship and/or immigration issues; and (E) Employ a system of proper review to avoid conflict cases, and contact the City Prosecutor for possible resolution. Special Considerations: As the City is currently evaluating the efficiency of regionalizing its Court services, the contract will include a clause allowing termination in 180 days if it is initiated by either party.

TIME SCHEDULE
The City will follow a timetable, which should result in a selection of a firm by approximately December 4, 2018. Proposals will be accepted until 5:00 p.m. on November 5, 2018. Interviews of selected candidates will, if required, be scheduled in November, 2018. Proposals must be submitted in a sealed envelope with the outside clearly marked with “RFP – Public Defender” and the name and address of the proposer.
