Reserved Rights and Procedures: Pierce County expressly reserves the following rights:To waive any and/or all irregularities in the proposals submitted.To reject any or all proposals or portions thereof.To base awards with due regard to quality of services, experience, compliance with specifications, and other such factors as may be necessary in the circumstances.To make the award to any vendor or combination of vendors whose proposal(s), in the opinion of the County, is in the best interest of the County.Pierce County cannot accept late proposals.Reimbursement: The County will not reimburse proposers for any costs involved in the preparation and submission of responses to this RFP or in the preparation for and attendance at subsequent interviews.Cooperative PurchasingThe Washington State Interlocal Cooperation Act, Ch. 39.34 RCW, authorizes public agencies to cooperatively purchase goods and services if all parties agree. By responding to this RFP, Consultants agree that other public agencies may purchase goods and services under this solicitation or contract at their own cost and without Pierce County incurring any financial or legal liability for such purchases. Pierce County agrees to allow other public agencies to purchase goods and services under this solicitation or contract, provided that Pierce County is not held financially or legally liable for purchases and that any public agency purchasing under such solicitation or contract file a copy of this invitation and such contract in accordance with RCW 39.34.040.Public Records and Proprietary MaterialProposers should be aware that any records they submit to the County or that are used by the County even if the proposers possess the records may be public records under the Washington Public Records Act (RCW 42.56). The County must promptly disclose public records upon request unless a statute exempts them from disclosure. Proposers should also be aware that if even a portion of a record is exempt from disclosure, generally, the rest of the record must be disclosed. Exemptions are narrow and specific.Proposers should clearly mark any record they believe is exempt from disclosure.Title VI CompliancePierce County, in accordance with Title VI of the Civil Rights Act of 1964, 78 Stat. 252, 42 U.S.C. 2000d to 2000d-4 and Title 49, Code of Federal Regulations, Department of Transportation, subtitle A, Office of the Secretary, Part 21, nondiscrimination in federally assisted programs of the Department of Transportation issued pursuant to such Act, hereby notifies all bidders that it will affirmatively ensure that in any contract entered into pursuant to this advertisement, disadvantaged business enterprises as defined at 49 CFR Part 26 will be afforded full opportunity to submit bids in response to this invitation and will not be discriminated against on the grounds of race, color, or national origin in consideration for an award.

Federal Terms & Conditions
Without limitation as otherwise set forth in this Agreement, Subrecipient shall comply with all relevant Catalog of Federal Domestic Assistance (CFDA) Listing Requirements, as amended, and supplemented. Specifically, but not by way of limitation, CFDA 21.027 has the following policy requirements: 31 CFR Part 35, as amended by the Interim final rule published May 17, 2021, at 26786 FR Vol. 86, No. 93; or otherwise subsequently amended by Final Rule.2 CFR Part 200, including Subparts B through FAdditional Information: The following 2 CFR Policy requirements also apply to this assistance listing: 2 CFR Part 25, Universal Identifier and System for Award Management; 2 CFR Part 170, Reporting Subaward and Executive Compensation Information; and 2 CFR Part 180, OMB Guidelines to Agencies on Governmentwide Debarment and Suspension (Non-procurement). The following 2 CFR Policy requirements are excluded from coverage under this assistance listing: For 2 CFR Part 200, Subpart C, the following provisions do not apply to the SLFRF program: 2 CFR § 200.204 (Notices of Funding Opportunities); 2 CFR § 200.205 (Federal awarding agency review of merit of proposal); 2 CFR § 200.210 (Pre-award costs); and 2 CFR § 200.213 (Reporting a determination that a non-Federal entity is not qualified for a Federal award). Byrd Anti-Lobbying Amendment Compliance and Certification Form
The following certification regarding payments to influence certain federal transactions are made per the provisions contained in FAR 52.203-11 and 52.203-12 and 31 U.S.C. 1352. FAR 52.203-12, “Limitation on Payments to Influence Certain Federal Transactions” is hereby incorporated by reference into this certification. Authorized Official of Subrecipient, on behalf of Subrecipient, hereby certifies to the best of his or her knowledge and belief that:No Federal appropriated funds have been paid or will be paid to any person for influencing or attempting to influence an officer or employee of any agency, a Member of Congress, an officer or employee of Congress, or an employee of a Member of Congress on his or her behalf in connection with the awarding of any Federal Agreement, the making of any Federal grant, the making of any Federal loan, the entering into of any cooperative agreement, and the extension, continuation, renewal, amendment or modification of any Federal Agreement, grant, loan, or cooperative agreement. If any funds other than Federal appropriated funds (including profit or fee received under a covered Federal transaction) have been paid, or will be paid, to any person for influencing or attempting to influence an officer or employee of any agency, a Member of Congress, and officer or employee of Congress, or an employee of a Member of Congress on his or her behalf in connection with this solicitation, Authorized Official of Subrecipient shall complete and submit, along with the execution of this Agreement, OMB standard form LLL, Disclosure of Lobbying Activities, to County; andAuthorized Official of Subrecipient will include the language of this Certification in all agreements with its subrecipients, contractors, consultants, and agents who are paid from funds provided under this Agreement or act in furtherance of this Agreement, as applicable in accordance with relevant federal law and regulations as may be amended and supplemented. This certification is a material representation of fact upon which reliance is placed when this Agreement was made or entered into. Submission of this certification is a prerequisite for making or entering into this Agreement imposed by section 31 U.S.C. 1352. Any person making an expenditure prohibited under this provision or who fails to file or amend the disclosure form to be filed or amended by this provision, shall be subject to a civil penalty of not less than $10,000, and not more than $100,000, for each such failure.

Food and Beverage Vending Machines Scope of Work
The County will provide space and utilities for vending machines in return for a percentage of monies collected at Parks and Recreation facilities. Interested potential proposers should meet the following conditions: Vendor ResponsibilitiesVendor agrees to furnish, install, maintain and stock coin/card operated vending machines at: Sprinker Recreation Center 521 Military Rd S, Tacoma 98444 Lakewood Community Center 9112 Lakewood Drive SW, Lakewood 98499 Equipment installed shall remain Vendor's sole and exclusive personal property and responsibility.All equipment shall be new or like new and kept clean and presentable to the public at all times. Equipment shall offer a choice of payment options including change machines. All vending machines will be equipped with card readers for credit card use.All equipment shall be restocked at least once per week with unexpired productAdditional restocking may be requestedVendor will be responsible for moving machines to different locations within the building if requested, at no charge.Vendor will be responsible for all damage to the County premises as the result of any act or omission of the Vendor, including all subcontractors. This includes all damage to the premises by the delivery, removal, repair and daily operation of vending machines, including electrical, water damage, fixtures, furnishings and infrastructure. Service and RepairsVendor shall maintain and service their own equipment at their expense, including service, inspection, cleaning and necessary repairs, including maintenance due to vandalism. Vendor shall provide the maintenance, repairs and service needed to keep all equipment in good repair and in a clean, sanitary and orderly condition and appearance.The County requires that requests for service be responded to within 12 hours, seven days a week. “Response” is defined as the arrival of a trained repair person/technician, properly equipped with tools and materials necessary to facilitate required service or repairs.Replacement machines shall be provided by the Vendor, if determined by the County to be necessary. Reasons for replacement shall include, but not be limited by, interior or exterior deterioration or chronic malfunction.Revenue Collection, Reporting and Refunds Vendor will collect and account for all monies in the vending machine. Vendor will submit monthly or quarterly sales reports and commission payments to the County, which shall be subject to audits upon demand. Vendor shall process all refunds for vending machine not dispensing product, giving incorrect change, dispensing the wrong product, etc. and process/mail refunds to customers. Number / Type of Machines The quantity and type of machines will be determined by Vendor and County and will be dependent on the available space and needs of the County. The County reserves the right, on 30-days' notice, to add or delete machines covered by the resulting contract as the need arises in these or other County locations. Current types of machines include warm beverage machines, cold beverage machines, snack food machines and change machines. Pierce County Parks and Recreation is committed to an active healthy lifestyle. Vendors should offer healthy options for both snacks and beverages.

Procurement Questions and Submittal
All questions must be submitted within the County's eProcurement Portal, under the Questionnaire Section no later than 4:00 pm on Wednesday, February 25, 2026. Proposers must be registered in the eProcurement Portal software in order to submit questions, receive addendums and notifications, and ultimately submit a proposal.Proposals must be received by the Procurement & Contract Services Department before 4:00 pm on Wednesday, March 11, 2026. The proposer/bidder/applicant is responsible for submission of proposal before the deadline. The County shall not be responsible for late submittals. Exceptions will not be made for proposers/bidders/applicants who miss the submission deadline and no proposals will be accepted via email.

Expected Term of Resulting Contract
The initial contract period is anticipated to be for 1 (one) year. The County has the option of renewing for an additional 4 (four) after initial contract is executed. The actual schedule will be negotiated with the selected organization(s) based on the finalized scope of work, funding, and services being purchased.

Washington State Department of Services for the Blind (DSB) Requirements
The locations identified in this RFP are non-administrative buildings. The County's determination is subject to change at any time throughout the term of an awarded contract.
